Claiming Asylum

To become a refugee in the UK or any part of the World, you must apply for asylum. The Home Office is the government department that is responsible for all asylum applications in the UK. It is responsible to make decision on your application. When ones you are in the process waiting for your decision, you are been regarded as an asylum seeker. If you are granted a status, (ILR, ELR, ELE) you are not longer an asylum seeker but a refugee.

There are two ways for people to apply for asylum:-

  • To the immigration officer when they arrive at the port of entry i.e. (airport, seaport or at Waterloo Train Station if they came through the channel Tunnel).
  • They are called "port applicant."Or making an application at the Home Office after making an entry legally or illegally. They are called "country applicant".

If you have traveled through the European Union, Canada, The USA, Switzerland or Norway before putting in an application for asylum, your case may be rejected on "safe third party’ grounds. If this happens then you need a legal advice immediately.

.: Who is a Refugee?

A Refugee is someone who has flee his or her country or is unable to return or his or her country because they fear persecution. The United Kingdom as a signatory to the United Nation Convention for Refugee of 1957 and the protocol on refugees, has a responsibility towards Refugees. The convention says a refugee is someone who is forced to flee his or her country due to:-

" A well founded fear of precaution due to race, religion, nationality, political opinion or member of a political group".
